El objetivo principal es examinar las sentencias judiciales emitidas entre 2015 y 2023 por la Suprema Corte de Justicia de la provincia de Jujuy, tras la implementación del nuevo Código Civil y Comercial (2015), evaluando las tensiones entre los derechos individuales y colectivos dentro del marco legal argentino y su impacto en las comunidades indígenas. Utilizando un enfoque cualitativo, la investigación emplea el estudio de casos para explorar las experiencias de las comunidades en torno a la tenencia de la tierra y sus implicancias jurídicas. Las sentencias judiciales seleccionadas proporcionan una base sólida para analizar cómo se han gestionado estos conflictos en el ámbito judicial, mientras que las entrevistas semiestructuradas con comuneros ofrecen una perspectiva vivencial, cultural y humana que complementa el análisis legal. Estas entrevistas, realizadas con miembros de las comunidades afectadas, permitieron capturar la dimensión subjetiva de los conflictos, evidenciando cómo las comunidades perciben las sentencias judiciales y cómo estas influyen en sus estrategias de resistencia y organización territorial. La triangulación de fuentes facilita la comprensión holística y multidimensional de la problemática, permitiendo identificar patrones, tensiones y desafíos en la interacción entre el sistema legal estatal y las realidades socioculturales de las comunidades indígenas. Los resultados revelan que, si bien el marco normativo vigente reconoce derechos colectivos de los pueblos indígenas, en la práctica, las sentencias judiciales tienden a priorizar los derechos individuales sobre los colectivos, reproduciendo así estructuras coloniales que perpetúan la exclusión de las comunidades aborígenes. Las entrevistas reflejan un sentimiento generalizado de desconfianza hacia el sistema judicial, percibido como ajeno a las realidades y cosmovisiones indígenas. No obstante, a pesar de estas limitaciones, las comunidades continúan utilizando el sistema judicial como una herramienta de resistencia frente a las presiones estatales y económicas que amenazan sus territorios. Una de las conclusiones más destacadas es que el pluralismo jurídico, reconocido formalmente en el nuevo Código Civil y Comercial, presenta grandes desafíos para su implementación efectiva. El sistema judicial no logra integrar plenamente las particularidades culturales de las comunidades indígenas, lo que genera tensiones entre las normativas formales de propiedad individual y la cosmovisión indígena de la tierra como un bien colectivo y culturalmente significativo. Al respecto, tanto Gabriela Pedroza como Néstor García Canclini coinciden en afirmar que en la actualidad es impensable una apropiación igualitaria de los contenidos de los mensajes/productos comunicacionales. Pedroza postula la existencia de "(...) nuevas comunidades de interpretación que producen, en la medida de sus espacios creativos de significación(...). Estos grupos poseerían entre otras características una identidad que les diera una forma de vinculación, dotando a los miembros que se adscribieran a ella de una unidad en ciertos rasgos que les permiten sentirse parte de algo más que su círculo inmediato (...)” . Asimismo, Pedroza señala que las nuevas redes de información y comunicación - sumadas a los nuevos sistemas de producción y acumulación- produjeron transformaciones en los conceptos de tiempo y espacio. En el orden temporal, se crea la posibilidad de simultaneidad en las interacciones sociales, rompiendo con las barreras de los horarios diferenciados, instaurando una suerte de "tiempo virtual" que no obedece al reloj tradicional.
