Descripción

Constitutional review is situated within the broader political and legal problem of reconciling the predominance of the majority with unconditional respect for the fundamental rights protected by the supreme legal instrument: the Constitution. In our country, it is exercised by the judiciary, whose members thus become the interpreters and guarantors of the Constitution.
This paper points out some problems related to constitutional review that generally do not appear in discussions of the subject. These are problems that are not recognized, either socially or legally, as violations of rights and freedoms, and that particularly affect women as a collective in their condition as women.
The disregard for women’s autonomy by a large part of the judiciary, especially in the area of sexuality and reproduction, is expressed in norms and judicial decisions grounded in the traditional model of femininity, maternal and dependent, which hinders the possibility of recognizing women as subjects with decision-making capacity.
It is possible to show that, although a law may have no relation to sex, it can be applied in a discriminatory manner or fail to protect certain rights. Law, in theory and in practice, does not operate with the same categories when referring to men and women. These differences are framed within the social constructions that have historically defined what it means to be a woman and what it means to be a man, to the detriment of women as a collective, and have long dismissed their capacity to be full citizens.
